Copyright Policy
1. General information
Crab respects the copyright rights and/ or intellectual property of its users and other people. If you believe that your rights have been violated in any way, Crab has an established procedure for dealing with complaints based on Digital Millennium Copyright Act (DMCA).Section 512 of DMCA provides the rules for reporting copyright infringement and for filing a counter-notification.
If you believe that your copyright and / or intellectual property rights have been in fringed, then we ask you to notify us in an established writing form based on DMCA directly to our legal department on hello@crab.global. In case of copyright infringement will be established and confirmed, the materials with in appropriate content will be deleted from the website. Crab reserves the right to contact the person whose rights have been infringed and to provide them with the materials necessary for analyzing the claim. The applicant agrees that their complaint may be forwarded to third parties. Material may be left on Crab in case of received permission from the author and/or their agent. For its part, Crab constantly tries to detect and remove inappropriate materials that violate the law, rights of third parties and / or users.
2. Notice of removal
If you believe your rights have been violated or may be violated, we ask you to write us a written notice stating the following in it:
- A reference to an object that violates the laws and/or your rights or the rights of third parties; your contact details (phone, email , postal address);
- If the object violates your own rights, then we ask you to provide with your notice supporting documents, which could indicate that you are a legitimate owner of published materials;
- A statement that you believe that you or your agent did not give permission for the publication of materials;
- Your signature (or digital signature)at the end of the statement; A statement, under penalty of perjury, that the information in the notification is accurate.
Crab, for its part, undertakes to promptly review your complaint in 10 business days and make a decision about which you will be notified.
3. Counter-notification
1. If you believe that the allegedly in fringing material is not infringing and want Crab to restore it on its website, please send a counter-notification to Crab designated legal department as provided below.
2. To be considered valid, your counter-notification must be in written form and consist next information:
- A statement identifying the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
- A statement identifying the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
- A statement that you consent that all disputes shall be settled by the court of proper jurisdiction under the current legislation of Ukraine.
Your signature (the signature may be electronic).
Crab after receipt of a valid counter-notification, will forward it to the party who submitted the original removal notification. Crab will not restore removed materials in case of receiving in 10 business days, an action is filed seeking court order to restrain you from engaging in the allegedly infringing activity. In case Crab will not receive such notification removed information might be restored in 14 business days. You may email your notice to hello@crab.global.Please indicate “DMCA notification”.
